Who are We

Anneka Ireland Videography and our trading office is at 14 Westbrook Terrace, Tunbridge Wells, Kent TN2 5BP.       

Anneka Ireland Videography (“Us” or “We”) offers filming services for weddings and other memorable occasions (“Goods and Services”).

Provision of Goods and Services

These Terms and Conditions (the “Terms”) represent the sale and provision of Goods and Services by Us and will form the basis of the Contract between Us and our customers (“You”).  Before submitting an Order, please ensure that you have read these Terms carefully.  If you are unsure about any part of these Terms, please ask Us for clarification.

Your Order constitutes a contractual offer that We may, at our discretion, accept. A legally binding contract between Us and you will be created upon our acceptance of your Order, to purchase our Goods and Services (“Order”) indicated by Our Order Confirmation. Any such Order Confirmation will be provided in writing to you either by email or by post.

By placing an Order with Us, You will acknowledge that you have read and fully understand the terms of the wedding contract and realise that this contract becomes effective immediately. These Terms do not affect your statutory rights.

Booking Form

Our booking form is incorporated in to these Terms and will be legally binding. It is mutually agreed that the filmmaker shall supply the services and goods specified in the Wedding Booking form, and that the client shall pay the price agreed by email.

Booking Fee

A non-refundable booking fee of £300.00 is payable at the time of booking to secure the date. Payment of the booking fee confirms your acceptance of these Terms and Conditions and forms a legally binding contract between Anneka Ireland Videography and You. This fee is deductible from the final balance.

Payment

The balance (less booking fee) is due 28 days prior to the wedding date and will be payable by You upon receipt of Our invoice. Accepted methods of payment are BACS or cash.

Please note that the Goods and Services will not be transferred until We have received payment in full.

Traveling Expenses

All packages include travel expenses up to 2 hours from our studio (TN2). For distances greater than this We reserve the right to charge for any extra motoring, rail or overnight accommodation expenses.

Cancellation

You have the right to cancel this Order within 14 days of placing it with Us in accordance with your statutory rights and this is the only occasion, We will refund any deposit paid by You.

Notwithstanding the above, You may cancel this contract at any time prior to the event by giving written notice to Anneka Ireland Videography and the booking fee will be retained by Us, with no further fees payable.

If You cancel this contract within 1 month of the wedding, then the full agreed price will be payable by You under all circumstances.

 

Anneka Ireland Videography will not charge any additional fees for moving the wedding date within the one-year time period. Weddings re-booked further than one year out may incur additional fees in line with package changes.

Anneka Ireland Videography reserves the right to charge travel, subsistence and accommodation costs if a new venue is booked which is not in the same 2 hour geographical area as the original wedding venue.

GDPR Compliance

We are committed to protecting your personal data in line with the General Data Protection Regulation (GDPR). Any personal information provided by You will be handled securely and only used for the purpose of delivering our services to You. We do not share your data with third parties without your explicit consent unless required by law. For further details on how we manage your data, please refer to our Privacy Policy available on our website.

Coverage

We will take all reasonable steps to ensure that the video is captured professionally and without issues. However, We are of course all subject to things that may happen beyond our control.

Coverage will be as the cameraman’s professional expertise determines and no one scene will be determined more important than another. Anneka Ireland Videography cannot guarantee coverage of any particular event or individual on the day.

Anneka Ireland Videography will make all reasonable efforts to ensure high-quality audio capture during the event. However, The Videographer cannot be held responsible if a speaker or participant refuses to wear an audio recorder or microphone on the day.

We use broadcast quality well maintained equipment, however We are not liable for any radio signal losses, battery failure, equipment failure or material defects which are beyond our control. Every reasonable effort will be made to arrange a replacement cameraman should it be necessary to do so.

In the unlikely event of a total video failure our liabilities are limited to a refund of all monies paid by the Client. Anneka Ireland Videography also recommends all Clients to purchase adequate wedding insurance to cover such instances.

Artistic Freedom

Anneka Ireland Videography retains full artistic freedom in capturing and editing the footage. This includes but is not limited to the choice of angles, lighting, and editing style. By engaging Anneka Ireland Videography, The Client agrees to accept the final product as a reflection of The Videographer’s professional expertise and creative vision.

Notification of Other Videographers

Anneka Ireland Videography must be notified in writing at least 14 days in advance if another professional videographer or videography team will be present at the wedding or event. This is to ensure coordination and avoid disruptions to our workflow.

Failure to provide such notification may result in the termination of services, with no refund of the deposit or payments made. This requirement does not extend to informal content creators, such as guests using personal devices.

Anneka Ireland Videography reserves the right to request exclusivity as the sole professional videographer at the event to ensure the highest quality of service and to avoid conflicts in filming logistics and creative direction.

Equipment Damage

The Client agrees to take full financial responsibility for any damage to The Videographer’s equipment caused by The Client, their guests, or any other individuals associated with the event. In the event of damage, The Client will be required to cover the cost of repair or replacement at the current market value.

Safety of The Videographer

If The Videographer feels unsafe or threatened during the wedding day or event due to the actions of The Client, their guests, or venue staff, The Videographer reserves the right to cease filming immediately. No refunds will be issued for the portion of the event missed due to these circumstances. If deemed necessary, The Videographer may leave the premises entirely to ensure their safety and well-being.

Drone Operation

Anneka Ireland Videography holds the necessary licenses and insurance for drone operations. However, drone use is subject to weather conditions, venue restrictions, and compliance with local laws and regulations. The Videographer cannot guarantee drone footage if conditions are deemed unsafe or prohibited by the venue or relevant authorities. No refunds will be provided for the absence of drone footage under these circumstances.

The Edit

Anneka Ireland Videography aims to send the film at a maximum of 10 weeks after the wedding date. Up to 3 small changes are accepted and any additional changes may be subjected to a charge. Upon delivery of the download link the Contract will be deemed as fulfilled.

We will archive a Client’s film at 3 months from delivery of the film, after this, further editing changes will not be accepted.  After 1 year from the delivery date, Anneka Ireland Videography is not liable for retaining a copy of the film.

Music and Licensing

We use fully licensed music within our films to ensure compliance with copyright laws.

It is the Clients responsibility to ensure that the correct licenses have been purchased for a church ceremony, musicians and entertainers. (PRS for Music)

Recommendations

Clients are advised to inform their ceremony venue that they intend to have the wedding filmed. This avoids the disappointment of being refused on the day. If this situation occurs Anneka Ireland Videography will not refund any payment.

As Anneka Ireland Videography strives to unobtrusively capture your day, We try to avoid the added attention created by camera lights. Therefore We recommend that Clients selecting evening coverage make sure their DJ has adequate lighting for the dance floor. This will enhance the footage taken without drawing attention to the camera.

We strongly advise that back-ups of the films are make upon receiving the download link. Should they become misplaced, Anneka Ireland Videography will charge a replacement fee. 

Copyright

At all times, We retain the copyright of all the videography produced and all the original files remain the property of A Ireland-Wolfe. It is not our policy to provide the raw footage to Clients or third parties.

Clients are granted a personal, non-commercial license to use and share the final edited videos. This license permits sharing on social media platforms, with family and friends, or through other personal channels. However, the videos may not be altered, edited, or modified in any way, including but not limited to re-editing, applying filters, or cutting portions of the footage.

Any video content intended for commercial use (e.g., business promotion or advertisements) requires explicit written consent and may be subject to additional licensing fees.

General

We shall have no responsibility or liability for any failure to perform, or delay in performance or any of our obligations under the Terms that is caused by events outside of our control.

You may not assign your rights and obligations under these Terms to any party, and any purported attempt to do so will be null and void. We may transfer (assign) our obligations and rights under these Terms (and under the Contract, as applicable) to a third party (this may happen, for example, if we sell our business).  If this occurs, You will be informed by us in writing.  Your rights under these Terms will not be affected and our obligations under these Terms will be transferred to the third party who will remain bound by them.

If any part of these Terms is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.

These Terms, the Contract, and the relationship between You and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with English law and subject to English jurisdiction.
